TERMS AND CONDITIONS
"Cyber Month" Campaign
1.1 Campaign: A campaign called “CYBER MONTH”, launched by Korner S.A.S., with the purpose of promoting the sale of properties in the projects NORTH POINT STUDIOS 3, NORTH POINT LIFT, SOLAR 2, and FRESNO, through the following mechanics: reserve a property and win an instant prize according to the prize table. The campaign is aimed at individuals who meet the requirements outlined in this document during the campaign period.
1.2 Project: Refers to the real estate projects NORTH POINT STUDIOS 3, NORTH POINT LIFT, SOLAR 2, and FRESNO, developed by Korner S.A.S.
1.3 Participants: Any individual interested in acquiring a private unit in the Projects, provided they meet the conditions established in this document.
1.4 Prize:
The prize pool includes the delivery of thirty units of prizes previously selected by Korner.
STUDIOS 3: Amazon Echo Dot 5th Gen Speaker with Alexa: 10 Units
SOLAR 2: Amazon Echo Dot 5th Gen Speaker with Alexa: 10 Units
NORTH POINT LIFT: Robotic Vacuum Cleaner 0.22 L 120V ERB10: 5 Units
FRESNO: Robotic Vacuum Cleaner 0.22 L 120V ERB10: 5 Units
1.5 Legalization: During the validity period of this Campaign, Participants must carry out and comply with the following activities:
Full payment of the amount equivalent to the property reservation fee, which must be $1,500,000.
Completion of the full process of affiliation with the trust company assigned to the project as the Responsible Party.
Signing of all documents required by KORNER S.A.S. and/or the respective trust company.
Verification and approval by the head of the sales office of the fulfillment of the previous milestones.
Approval of the mortgage loan and housing subsidy for the purchase of the property, and submission to KORNER S.A.S. of the supporting documents that certify it. In the event that the Participant purchases the housing unit through a one-time full payment, they may participate once all other requirements outlined in this section have been met.
REQUIREMENTS TO PARTICIPATE
The requirements that Participants of this Campaign must meet are:
Be of legal age.
Make the reservation payment for a property in one of the participating projects.
CAMPAIGN DISCLOSURE AND ACCEPTANCE:
This Campaign will be communicated to Participants through channels such as the KORNER S.A.S. website and social media, along with any other means of communication that allow it to reach the largest number of potential Participants. All Participants must acknowledge and accept all the conditions of the Campaign by signing this document, which contains the terms and conditions and will form part of the documentation required to formalize the purchase of the housing units.
CAMPAIGN MECHANICS:
Korner S.A.S. will promote the Campaign in accordance with the provisions set forth in Section 3 of this document.
If the Participant wishes to acquire a housing unit in any of the projects — NORTH POINT STUDIOS 3, NORTH POINT LIFT, SOLAR 2, or FRESNO — they must complete all the procedures outlined in Section 1.5 of this document. Once the reservation is made, the Participant will receive the corresponding prize at the KORNER S.A.S. sales office. The document that entitles the Participant to the prize will be signed and stamped exclusively by the head of the sales office.
FIRST PARAGRAPH: If the housing unit from the projects NORTH POINT STUDIOS 3, NORTH POINT LIFT, SOLAR 2, or FRESNO is purchased by more than one person, only one of them will be eligible to receive the prize, and only one prize will be awarded per unit, according to the project.
SECOND PARAGRAPH: Failure by the Participant to comply with any of their obligations as the party responsible and/or subsequent prospective buyers may result in Korner S.A.S. revoking the prize, without prejudice to the continuation of the relationship established between the Parties by virtue of the reservation of the housing unit.
THIRD PARAGRAPH: This Campaign cannot be combined with other promotions and/or discounts.
FOURTH PARAGRAPH: The prizes mentioned above are non-transferable, non-redeemable for cash, and cannot be exchanged for other goods or discounts.
FIFTH PARAGRAPH: KORNER S.A.S. reserves the right to partially or fully suspend this Campaign in the event of any force majeure or unforeseen circumstances, without this giving rise to any payment, compensation, or indemnification in favor of any of the Parties.
SIXTH PARAGRAPH: If a participant reserves two (2) or more real estate units in the same project or in different projects, they may participate for each unit to obtain the prize corresponding to the selected project. However, to be one of the potential winners, they must individually meet all the required conditions. Otherwise, they can only be considered a potential winner for the unit that meets the requirements set forth in section 1.5 of this document.
SEVENTH PARAGRAPH: If one of the winners withdraws from the transaction before signing the purchase agreement and a refund is issued, the value of the prize awarded will be deducted from the refunded amount.
EIGHTH PARAGRAPH: Any disputes arising in relation to this Campaign that are not covered in this document shall be resolved in accordance with the provisions of the law.
NINTH PARAGRAPH: KORNER S.A.S. reserves the right to make modifications, additions, or clarifications to this document if deemed necessary, which will be communicated through the means indicated in Section 3 of this document. In such cases, KORNER S.A.S. may also send this information to the contact email addresses provided by the Participants.
TENTH PARAGRAPH: KORNER S.A.S. reserves the right to revoke the prize if it is found to have been obtained fraudulently, such as through the provision of false information. Additionally, KORNER S.A.S. may take appropriate legal action as necessary.
ELEVENTH PARAGRAPH: Participants may claim their prize within thirty (30) calendar days following its award. If the Participant does not claim the prize within this period, it will be understood that they forfeit it, and KORNER will be free to dispose of the prize as it sees fit.
CAMPAIGN DURATION:
This Campaign will be in effect from November 15th to December 15th, 2023, a period during which the requirements established in section 1.5 of these terms and conditions must be met, or until all thirty (30) prizes are awarded, whichever occurs first.
ACKNOWLEDGMENT AND ACCEPTANCE:
By signing this document, the buyer acknowledges and accepts the terms and conditions established by KORNER S.A.S. for the execution of this campaign.
